The Swiss Schuldbetreibung: A Unique Debt Enforcement System
Switzerland has one of the most structured and efficient debt enforcement systems in the world, governed by the Bundesgesetz über Schuldbetreibung und Konkurs (SchKG) of 1889. Unlike most countries where debt collection is primarily a judicial function, Switzerland delegates enforcement to specialized administrative bodies — the Betreibungsämter (debt collection offices) — operating independently from the courts.
Step 1: The Betreibungsbegehren (Enforcement Request)
The creditor initiates the process by filing a Betreibungsbegehren with the competent Betreibungsamt at the debtor\'s domicile. This request must identify the debtor, state the claim amount in Swiss francs, and specify the cause of the debt. No documentary evidence is required at this stage — the Betreibungsamt issues the Zahlungsbefehl based solely on the creditor\'s declaration.
Step 2: The Zahlungsbefehl (Payment Order)
Within approximately 1-2 weeks, the Betreibungsamt issues and serves a Zahlungsbefehl on the debtor. This document:
- Orders the debtor to pay the claimed amount plus interest and costs within 20 days;
- Notifies the debtor of their right to file Rechtsvorschlag (legal opposition) within 10 days of service;
- Warns that failure to pay or oppose will result in continuation of enforcement proceedings (Fortsetzung der Betreibung).
Step 3: Rechtsvorschlag (Legal Opposition)
The debtor can file Rechtsvorschlag within 10 days simply by declaring opposition — no reasons or evidence are required. Filing Rechtsvorschlag immediately halts the Betreibung. At this point, the creditor must obtain a court judgment to remove the Rechtsvorschlag by filing a Rechtsöffnungsverfahren.
Rechtsöffnung: Removing the Opposition
There are two types of Rechtsöffnung:
- Definitive Rechtsöffnung (Article 80 SchKG): Available when the creditor holds a final court judgment or equivalent. The court lifts the opposition summarily and enforcement continues.
- Provisorische Rechtsöffnung (Article 82 SchKG): Available when the creditor has a written acknowledgment of debt signed by the debtor. The court provisionally lifts the opposition, but the debtor can still challenge the claim in a substantive proceeding within 20 days.
Fortsetzung: Continuation to Seizure
If Rechtsvorschlag is removed (or never filed), the creditor can request Fortsetzung — continuation to Pfändung (seizure of assets). The Betreibungsamt then seizes sufficient assets to cover the debt plus all enforcement costs. Seized assets are realized (sold) and proceeds paid to the creditor.
