Polish Debt Collection: Wezwanie do Zapłaty and Nakaz Zapłaty
Poland has one of the most creditor-friendly debt recovery systems in Central Europe, combining a traditional pre-litigation demand letter (wezwanie do zapłaty) with an efficient judicial payment order procedure (nakaz zapłaty) governed by the Kodeks postępowania cywilnego (KPC — Code of Civil Procedure).
Stage 1: Wezwanie do Zapłaty (Demand for Payment)
A wezwanie do zapłaty is a formal pre-litigation demand letter. Under Article 455 of the Kodeks cywilny (KC — Civil Code), a debtor must perform their obligation without delay after receiving a demand for performance. While Polish law does not prescribe a specific format, a proper wezwanie do zapłaty should include:
- Exact identification of the creditor and debtor (names, addresses, NIP/PESEL numbers if applicable)
- Specific amount claimed (należność główna) with breakdown of principal and interest
- Legal basis for the claim (contract date, invoice numbers)
- A clear deadline for payment (usually 7-14 days)
- Warning of legal action if payment is not received
- Bank account details for payment
Delivery should be by registered mail with acknowledgment of receipt (listem poleconym za zwrotnym potwierdzeniem odbioru) or through a court bailiff (komornik sądowy) for evidentiary strength.
Stage 2: Nakaz Zapłaty (Payment Order)
If the wezwanie do zapłaty goes unanswered, the creditor can file a pozew (statement of claim) requesting a nakaz zapłaty. There are two types:
1. Nakaz Zapłaty w Postępowaniu Nakazowym (Order for Payment in Writ Proceedings)
Under Articles 484a-497 KPC, this is available when the creditor\'s claim is supported by an official document (urzędowy dokument), a bill of exchange accepted by the debtor (weksel), or a written acknowledgment of debt. The court issues the order within approximately 2-4 weeks. The debtor has 14 days to satisfy the claim or file objections (zarzuty).
2. Nakaz Zapłaty w Postępowaniu Upominawczym (Order for Payment in Admonitory Proceedings)
Under Articles 497(1)-505 KPC, this is the more common route for debts supported by invoices, contracts, and accounting records. The court reviews the evidence and issues the nakaz within 4-8 weeks. The debtor has 14 days to pay or file sprzeciw (opposition).
Costs and Fees
The court fee (opłata sądowa) for a payment order is 1.25% of the claim amount for claims up to PLN 20,000, and 5% for larger claims (capped at PLN 100,000). Attorney fees are regulated by the Rozporządzenie w sprawie opłat za czynności adwokackie and are recoverable from the debtor.
