What Is the Proceso Monitorio?
The proceso monitorio is Spain\'s streamlined judicial procedure for recovering unpaid monetary debts, governed by Articles 812 to 818 of the Ley de Enjuiciamiento Civil (LEC). It allows creditors to obtain a fast payment order from the court without a full trial, making it the most popular debt recovery mechanism in Spain. Since its introduction in 2000, it has become the most frequently used civil procedure, handling hundreds of thousands of cases annually.
The key advantage: if the debtor does not pay or oppose within 20 days, the court automatically converts the order into an enforceable title (título ejecutivo) equivalent to a judgment. For claims up to EUR 250,000 (raised from EUR 2,000,000 with the 2024 reforms), the proceso monitorio is the fastest route to an enforceable title in Spain.
Requirements for a Proceso Monitorio
Under Article 812 LEC, the creditor must demonstrate the debt through documentary evidence. Acceptable documents include:
- Invoices (facturas) signed or acknowledged by the debtor
- Delivery notes (albaranes) signed by the recipient
- Contracts and agreements
- Email or fax correspondence acknowledging the debt
- Certified accounting records
- Bills of exchange (letras de cambio) or promissory notes (pagarés)
Step-by-Step Procedure
- File the petición inicial: Submit a petition to the Juzgado de Primera Instancia of the debtor\'s domicile. The petition must include the creditor\'s and debtor\'s details, the exact amount claimed, and the documentary evidence. Standardized forms (formularios normalizados) are available at most courts.
- Court review: The Letrado de la Administración de Justicia (LAJ) reviews the petition. If documents are sufficient, the court issues a requerimiento de pago — a payment order — without hearing the debtor.
- Service on debtor: The debtor has 20 days (días hábiles) to either pay or file opposition (oposición).
- Three possible outcomes:
- Payment: The debtor pays within 20 days. The procedure ends.
- No response: The LAJ issues a decreto ending the procedure, which becomes an enforceable title (título ejecutivo). The creditor can proceed directly to execution (ejecución).
- Opposition: If the debtor opposes in writing, the case converts to either the juicio verbal (for claims up to EUR 15,000) or juicio ordinario (for larger claims), requiring a full trial.
Costs and Attorney Requirements
For claims up to EUR 2,000, you do not need an attorney (abogado) or court representative (procurador). For claims above EUR 2,000, representation by abogado and procurador is mandatory. Court fees (tasas judiciales) apply only to legal entities (personas jurídicas); individuals are generally exempt.
