Argentina\'s Unique Legal Instrument: The Carta Documento
Argentina has one of the most distinctive pre-litigation instruments in the world: the carta documento. This is not merely a letter sent by registered mail — it is a formal legal document issued and certified by the Correo Argentino (Argentine Postal Service), which serves as a quasi-notarial function in certifying the content, date, and delivery of the communication.
Under the Código Civil y Comercial de la Nación (CCCN, enacted 2015), the carta documento is extensively regulated. The Correo Argentino maintains the exact content of each carta documento in its archives and can produce certified copies when required for litigation. The service also verifies the sender\'s identity and signature before issuing the document.
How a Carta Documento Works
- Drafting: The sender drafts the letter — typically with legal assistance (abogado). The content can be in Spanish and must be clear, precise, and respectful.
- Submission to Correo Argentino: The sender presents identification (DNI for individuals, estatuto/CUIT for companies) and signs the document at the postal counter. The postal employee verifies identity and issues the carta documento in triplicate (original, copy for sender, copy for Correo archives).
- Delivery: The Correo delivers the carta documento to the recipient\'s address. If the recipient refuses to sign or is not present, the postal worker leaves a notice (aviso de visita) and the recipient must collect it within 5 business days — otherwise, it is considered delivered (notificación tácita).
Legal Effects of a Carta Documento
Under Argentinian law, the carta documento has powerful legal effects:
- Constitutes default (constitución en mora): Under Article 886 CCCN, the debtor is in default upon interpelación (formal demand). The carta documento is the primary means of interpelación.
- Interrupts prescription (prescripción): Under Article 2545 CCCN, a carta documento interrupts the statute of limitations (prescripción liberatoria).
- Formal notice for contract termination: Under Article 1088 CCCN for locación (leases), a carta documento is the required method for formal notice of termination or renewal.
- Evidence in litigation: The Correo\'s certification provides irrefutable evidence of content, date, and delivery — making it extremely difficult for the recipient to deny receipt.
- Labor law notices: Under Ley de Contrato de Trabajo 20.744, employers must use carta documento for certain employment-related communications, including dismissals and sanctions.
Cost and Practicality
As of 2025, the cost of sending a carta documento is approximately ARS 2,000-5,000 (approx. USD 2-5), making it remarkably accessible. This low cost, combined with strong legal effects, makes it the default pre-litigation instrument in virtually all Argentinian legal disputes — from consumer complaints to multi-million dollar commercial claims.
