Sweden\'s Unique Payment Order System: Betalningsföreläggande

Sweden has one of the most efficient summary debt collection procedures in Europe. A betalningsföreläggande (payment order) is issued not by a court but by Kronofogdemyndigheten — the Swedish Enforcement Authority. This administrative procedure, governed by the Lag om betalningsföreläggande och handräckning (1989:822), allows creditors to obtain an enforceable title without any court involvement.

How the Kronofogden Procedure Works

  1. Application (ansökan): The creditor files an application with Kronofogden, either online (via kronofogden.se) or by mail. The application must specify the claim amount, basis for the debt, and interest claimed. The application fee is SEK 300.
  2. Review by Kronofogden: Kronofogden examines the application for formal completeness but does NOT review the merits of the claim. If the application is formally correct, Kronofogden serves it on the debtor.
  3. Debtor\'s response: The debtor must respond within a specified time (usually 14-21 days). The debtor has three options:
    • Pay immediately: The process ends.
    • Accept (godkänna): The debtor accepts the claim. Kronofogden issues a decision (utslag) that becomes enforceable.
    • Dispute (bestrida): The debtor disputes the claim. If the debtor disputes, Kronofogden cannot decide the case — the creditor must then choose whether to take the case to tingsrätt (district court).
  4. Utslag: If the debtor does not respond or accepts the claim, Kronofogden issues an utslag (decision), which has the same legal force as a court judgment (dom). The creditor can then proceed directly to enforcement (utmätning).

Advantages Over Court Proceedings

  • Speed: The entire process from application to enforceable utslag takes approximately 4-8 weeks if uncontested.
  • Cost: The SEK 300 application fee is dramatically lower than court litigation costs.
  • No legal representation needed: Both creditor and debtor can handle the process without an advokat.
  • Integrated enforcement: Kronofogden handles both the decision and subsequent enforcement, eliminating the gap between obtaining a judgment and collecting.

European Payment Order Comparison

While the EU created the European Order for Payment procedure (Regulation EC 1896/2006) to standardize cross-border debt recovery, Sweden\'s Kronofogden system remains the default for domestic debts. The Swedish system is notably faster than the German Mahnverfahren and more accessible than the Italian decreto ingiuntivo due to its administrative (rather than judicial) nature.
